    1. Acceptance of Terms

    These Terms & Conditions ("Terms") govern your access to and use of BlueJinn (the "Service"), operated by Converjinn AI Bilisim Teknolojileri ve Ticaret Anonim Sirketi ("BlueJinn", "we", "us", or "our").

    By creating an account, connecting an Instagram Business account, or using the Service, you agree to be bound by these Terms.

    If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

    If you do not agree to these Terms, you must not use the Service.

    2. Description of the Service

    BlueJinn is an AI-powered automation platform that integrates with Instagram Business accounts via Meta's official APIs.

    The Service enables businesses to:

    • Read and respond to Instagram Direct Messages
    • Automate customer conversations and booking workflows
    • Provide conversation analytics and reporting
    • Allow human operators to take over conversations

    The Service relies on Meta's API infrastructure, and functionality may depend on continued API availability.

    3. Eligibility and Account Requirements

    To use the Service, you must:

    • Be at least 18 years old or the legal age of majority in your jurisdiction
    • Own or have authorization to manage the Instagram Business account and associated Facebook Page you connect
    • Provide accurate and up-to-date account information
    • Maintain the confidentiality of your login credentials

    You are responsible for all activities conducted through your account.

    We reserve the right to suspend or terminate accounts that do not meet these requirements.

    4. Your Responsibilities

    By using BlueJinn, you agree to:

    • Comply with all applicable laws, including data protection and consumer protection regulations
    • Comply with Meta's Terms of Service, Platform Policies, and Community Standards
    • Inform your customers that automated tools may be used in responding to their messages
    • Ensure human oversight where required
    • Avoid sending spam, unsolicited promotions, or prohibited content
    • Respect Meta's messaging policies and rate limits

    You are solely responsible for the content sent from your connected Instagram account.

    5. Prohibited Uses

    You may not:

    • Use the Service to send bulk unsolicited messages or spam
    • Circumvent Meta's technical restrictions or API limits
    • Use customer data for unauthorized purposes
    • Reverse-engineer or interfere with the platform
    • Use the Service for unlawful, fraudulent, harmful, discriminatory, or abusive activities
    • Resell or sublicense access without written consent

    6. Meta Platform Compliance

    BlueJinn integrates with Meta's Graph API and related services. You acknowledge that:

    • BlueJinn is not affiliated with or endorsed by Meta Platforms, Inc.
    • Meta may modify, restrict, or revoke API access at any time
    • Certain features depend on Meta's continued API availability
    • You remain independently responsible for complying with Meta's policies

    You may revoke BlueJinn's access at any time through your Instagram or Facebook settings.

    7. Data Processing & Privacy

    Our handling of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

    Where you act as a data controller for your end-users' data, BlueJinn acts as a data processor for the limited purpose of providing the Service.

    8. Fees & Commercial Terms

    BlueJinn operates under individually negotiated service agreements with business customers. Pricing, scope of services, and payment terms are determined during onboarding and specified in your applicable agreement.

    Unless otherwise agreed in writing:

    • Fees are exclusive of applicable taxes
    • Payments must be made according to agreed timelines
    • Failure to pay may result in suspension or termination

    All fees are non-refundable unless otherwise agreed or required by law.

    9. Intellectual Property

    All rights, title, and interest in the Service — including software, design, branding, and content — remain the exclusive property of BlueJinn.

    You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service during your active subscription.

    Your own content and configurations remain your property.

    10. Disclaimer of Warranties

    The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no guarantees that:

    • The Service will be uninterrupted or error-free
    • Automated responses will always be accurate or suitable
    • Meta's APIs will remain available
    • Reservation workflows will be error-free

    You are responsible for reviewing automated responses and monitoring operational accuracy.

    11. Limitation of Liability

    To the maximum extent permitted by law:

    • BlueJinn shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities.
    • Our total aggregate liability shall not exceed the total fees paid by you in the three (3) months preceding the claim.

    12. Indemnification

    You agree to indemnify and hold harmless BlueJinn from claims arising out of:

    • Your use of the Service
    • Your violation of these Terms
    • Your violation of Meta's policies
    • Claims by your end-users related to messages sent via your account

    13. Termination

    Either party may terminate the Service in accordance with the applicable service agreement.

    We may suspend or terminate access immediately if you violate these Terms, Meta policies, or applicable law.

    Upon termination, data handling will follow the Privacy Policy.

    14. Governing Law

    These Terms are governed by the laws of the Republic of Turkey.

    15. Changes to Terms

    We may update these Terms from time to time. Material changes will be communicated in advance.

    Continued use of the Service constitutes acceptance of the updated Terms.

    16. Severability

    If any provision is found invalid, the remaining provisions remain in effect.
